Document Everything

Memory is unreliable. Credit reporting isn’t.

The difference between a dispute that gets "ignored" and a complaint that gets "upheld" is almost always the quality of the evidence log. Lenders and Debt Collection Agencies (DCAs) handle millions of accounts; they rely on you losing track of dates, misplacing letters, or forgetting what was said on a phone call.

When you document everything, you are building a Master Case File. This file is your primary weapon if you ever need to stand before a Judge or an Ombudsman.

The Audit Trail: What to Track

Every interaction with a creditor is a data point. You must record the following with surgical precision:

  • Dates Sent & Received: Never assume a letter arrived. Log the date you posted it and the date you received a reply.

  • Deadlines: The "8-Week Clock" for a final response is a legal requirement. Mark the expiry date in your calendar the moment you send a formal complaint.

  • Responses vs. Non-Responses: If a firm ignores your Section 77-79 CCA Request beyond 12 working days, that "Non-Response" is a specific legal breach. Mark it.

  • Escalation Points: Know exactly when a case moves from "Dispute" to "Complaint" to "Ombudsman."

The "Writing Only" Rule

The easiest way to document everything is to refuse to speak on the phone.

  • Phone calls are ephemeral: Unless you are recording them (which is legally complex), you have no proof of what was promised or threatened.

  • Letters are permanent: A letter is a static, timestamped piece of evidence. If a DCA tells you a debt is "Statute Barred" in a letter, they cannot take it back. If they say it on a call, they can deny it later.

How to Build Your Master Case File

You don't need expensive software. A simple folder or a digital spreadsheet is enough, provided it contains:

  1. The Correspondence Log: A list of every letter/email with a one-sentence summary of the content.

  2. The Screenshot Vault: Credit files change. Take a screenshot of the specific entry you are disputing before you start, and every time it updates.

  3. The Proof of Postage: If you send a physical letter, use Royal Mail Signed For. Staple the receipt to your copy of the letter. This proves the firm received it and prevents them from claiming "lost mail."

Persistence is the Only Outcome

The system is designed to be exhausting. It is a war of attrition. By documenting every step, you are proving to the lender that you are not going away.

When a FOS investigator opens your case and sees a neatly organised timeline of every breach, every ignored deadline, and every inconsistent report, they see a consumer who is correct. When they see a lender with missing records and vague responses, they see a firm that is non-compliant.

Accuracy is a right. Persistence is how you claim it.
